1. Service Description

4. Prohibited Activities

In addition to the Acceptable Use Policy, you are prohibited from:

You are granted a limited, non-exclusive, non-transferable license to access and use the services for your personal or internal business use only. This license does not include any resale or commercial use of the services or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the services or its contents; or any use of data mining, robots, or similar data gathering and extraction tools.

Any unauthorized use terminates the permission or license granted by Platatech. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows: your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.

6. User-Generated Content

Our services may allow users to submit, post, or transmit content, including but not limited to comments, feedback, or other materials ("User-Generated Content"). By submitting User-Generated Content, you grant Platatech a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that you own or control all rights to the User-Generated Content you submit and that the User-Generated Content is accurate, not confidential, and not in violation of any contractual restrictions or other third-party rights. Platatech takes no responsibility and assumes no liability for any User-Generated Content submitted by you or any other user of the services.

We reserve the right to remove or edit any User-Generated Content for any reason, including but not limited to violations of these Terms, at our sole discretion. We do not endorse any User-Generated Content and disclaim any and all liability for any User-Generated Content.

7. Payment Terms

Access to certain features of our services may require payment of fees. By subscribing to our services, you agree to pay all applicable fees as outlined on the Site. All fees are non-refundable unless otherwise stated. Platatech reserves the right to change its pricing at any time, but any changes will not affect your subscription until the end of your current billing cycle.

Payments will be processed through a third-party payment processor. You agree to provide accurate and complete payment information and authorize Platatech to charge your payment method for all fees incurred. You are responsible for any fees associated with your payment method, including any overdraft fees or currency conversion fees.

If you fail to make any payment when due, Platatech may suspend or terminate your access to the services until payment is received. You agree to pay all costs of collection, including reasonable attorney's fees, incurred by Platatech in enforcing these Terms.

8. Service Modifications

Platatech reserves the right to modify or discontinue, temporarily or permanently, the services (or any part thereof) with or without notice. You agree that Platatech will not be liable to you or to any third party for any modification, suspension, or discontinuance of the services.

We may also impose limits on certain features and services or restrict your access to parts or all of the services without notice or liability. Any new features that augment or enhance the current services shall also be subject to these Terms.

It is your responsibility to review these Terms periodically for changes. Your continued use of the services after any changes constitutes your acceptance of the new Terms.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Platatech, its affiliates, licensors, or service providers, or their respective officers, directors, employees, agents, contractors, successors, or assigns be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of, or inability to access or use, the services;
  • Any conduct or content of any third party on the services;
  • Any content obtained from the services; and
  • Unauthorized access, use, or alteration of your transmissions or content.

In no event shall Platatech’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the services during the twelve (12) months preceding the claim.

10. Termination

These Terms are effective until terminated by either you or Platatech. You may terminate these Terms at any time by discontinuing your use of the services and deleting your account. Platatech may terminate these Terms and your access to the services at any time, without notice, for any reason, including if we believe that you have violated these Terms.

Upon termination, your right to use the services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Upon termination, you must cease all use of the services and destroy any copies of the materials obtained from the services. Any termination of these Terms shall not affect any rights or liabilities of either party that have accrued prior to the date of termination.
